What is CPSIA?

The Consumer Product Safety Improvement Act (CPSIA) of 2008 is a United States law. This law amended CPSA in 2008 to provide CPSC with significant new regulatory and enforcement tools. CPSIA addresses, among other things, lead, phthalates, toy safety, third-party testing and certification, imports, ATVs, civil and criminal penalties and SaferProducts.gov. It repeals a funding limitation on the number of CPSC commissioners.

It specifically requires that lead content in the substrate materials in children’s toys is limited to 100 parts per million (ppm), while the lead content in surface coatings and paint is limited to 90 ppm. The regulation also restricts the amount of phthalates (including DBP, DEHP, or BBP) in children’s products to 0.1 %.

The CPSIA defines the term for children’s products. It is targeted mostly toward “children's products”, which are defined as any consumer product designed or intended primarily for children 12 years of age or younger.

  • Comply with all applicable children’s product safety rules;
  • Be tested for compliance by a CPSC-accepted accredited laboratory, unless subject to an exception;
  • Have a written Children’s Product Certificate that provides evidence of the product’s compliance;
  • Have permanent tracking information affixed to the product and its packaging where practicable.
